Terms of Service
These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and Klik Tik Ltd. ("Klik Tik," "Company," "we," "us," or "our"), governing your access to and use of the Klik Tik platform, including all related applications, services, tools, AI features, integrations, and APIs (collectively, the "Services" or "Platform").
If you are entering into this Agreement on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "Customer" or "you" refers to that entity.
1. Definitions
"Account" means the Customer's account on the Platform, including all associated Users, data, configurations, and settings within the Customer's Organization.
"Administrator" or "Admin" means a User designated by the Customer with elevated privileges to manage the Account, including adding or removing Users, configuring settings, managing integrations, and controlling access permissions.
"AI Features" means all artificial intelligence and machine learning capabilities within the Platform, including but not limited to the Julia AI assistant, auto-tagging, chatbot services, AI-powered analytics, content generation, voice interactions, flow automation with AI components, and any other AI-driven functionality.
"API" means the application programming interfaces provided by Klik Tik that allow programmatic access to the Platform's functionality.
"Authorized Users" or "Users" means the individuals authorized by the Customer to access and use the Services under the Customer's Account.
"Customer Data" means all data, content, files, documents, and information that the Customer or its Users upload, submit, store, transmit, or generate through the Platform.
"End Users" means the Customer's own clients, customers, prospects, or other third parties who interact with the Customer's public-facing features (booking pages, landing pages, forms, chatbot, document signing, public invoice views).
"Flows" means the automated workflows created by the Customer using the Platform's automation builder.
"Integrations" means connections between the Platform and third-party services, including but not limited to WooCommerce, Shopify, QuickBooks, Google Workspace, Instagram/Meta, Twilio, Stripe, and any other connected service.
"Julia" means the Platform's built-in AI assistant that provides chat, voice, analytics, CRM operations, content generation, and automated task capabilities.
"Organization" means the multi-tenant organizational unit associated with the Customer's Account, which serves as the primary data isolation boundary.
"Services" means the Klik Tik platform and all features, tools, APIs, integrations, AI capabilities, and support provided by Klik Tik under these Terms.
"Subscription" means the Customer's paid plan for accessing the Services.
"Third-Party Services" means any software, service, platform, or application not owned or operated by Klik Tik that may be accessed through, integrated with, or connected to the Platform.
2. Our Services
Klik Tik provides a multi-tenant, cloud-based SaaS Customer Relationship Management (CRM) platform designed for small and medium-sized businesses. The Platform includes, but is not limited to: CRM & Contact Management, Sales & Pipeline Management, Order & Product Management, Financial Management (invoices, quotes, credit notes, commissions, expenses), Payment Processing (via Stripe Connect, including application fees), Communication Tools (Gmail, SMS via Twilio, team chat), Appointments & Booking, Documents & Electronic Signatures, AI-Powered Features (Julia AI assistant, CRM agent, chatbot, auto-tagging, content generation, voice), Automation (visual flow builder), Project & Task Management, Employee & HR Management (including heartbeat-based activity monitoring), Analytics & Reporting, Third-Party Integrations, Public-Facing Features (booking pages, landing pages, forms, chatbot widgets, custom domains), Social Media Management, Promotions & Coupons, File Storage, and Notifications & Reminders (email, SMS, push via Firebase, in-app).
2.1 Service Modifications
Klik Tik reserves the right to modify, update, enhance, or discontinue any feature at any time, with or without notice. We will make reasonable efforts to notify Customers of material changes that adversely affect existing functionality.
2.2 Eligibility
You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an Account.
3. Account Registration & Administration
You are solely responsible for maintaining the confidentiality of your Account credentials, all activities that occur under your Account, and ensuring that your Users comply with these Terms. All actions taken by an Administrator are deemed authorized by the Customer.
The Platform supports multiple user roles (Admin, Team Leader, Manager, User). The Customer is responsible for properly assigning roles, configuring permissions, and revoking access for Users who no longer require it.
Klik Tik reserves the right to reclassify user roles if Users have been misclassified in a manner that circumvents usage limits or fee structures.
4. Customer Data & Ownership
The Customer retains all right, title, and interest in Customer Data. The Customer grants Klik Tik a non-exclusive, worldwide, royalty-free license to process Customer Data solely to provide the Services. Klik Tik may collect, use, and disclose aggregated, anonymized data for any lawful purpose. The Customer is responsible for data accuracy and is encouraged to maintain independent backups.
The Customer may access their data through the Platform's user interface and API. Export functionality may vary by data type and Subscription plan.
5. Prohibited Data & Content
Unless separately agreed in writing, the Customer shall NOT process: GDPR Article 9 special category data, HIPAA protected health information, PCI DSS payment card data, government-issued identification numbers (except for tax/invoicing), financial account credentials, export-controlled data, or data of minors under 13. The Customer assumes all risk and liability for uploading prohibited data.
6. Intellectual Property
Klik Tik retains all IP rights in the Services. The Customer receives a limited, non-exclusive, non-transferable, revocable license for internal business use during the Subscription term. The Customer shall not reverse engineer, sublicense, or use the Services to build competing products. Feedback provided by the Customer is assigned to Klik Tik.
7. AI-Powered Features (Julia & Automation)
AI outputs are not guaranteed to be accurate, complete, or error-free. The Customer is responsible for reviewing and approving all AI-generated outputs. AI-initiated CRM operations (creating contacts, orders, etc.) are at the Customer's risk. AI chatbot interactions with End Users are the Customer's responsibility. Voice AI interactions may be recorded and transmitted to third-party providers (VAPI). AI features may be subject to usage limits based on Subscription plan.
Customer Data processed by AI may be transmitted to third-party AI providers (such as Google Gemini). Klik Tik does NOT use Customer Data to train general-purpose AI models.
Automated workflows execute without human intervention once activated. The Customer is solely responsible for the design, testing, and consequences of all automated workflows.
8. Third-Party Integrations
Integrations are available with WooCommerce, Shopify, QuickBooks, Google Workspace, Instagram/Meta, Twilio, Stripe, Facebook Lead Ads, and custom webhooks. Each requires the Customer to comply with the respective third-party terms. Data synchronization may create, modify, or delete records. Klik Tik makes no warranties regarding third-party services and may discontinue integrations at any time.
9. Communication Services
Email integration (Gmail OAuth), SMS (Twilio), and team chat are subject to the Customer's compliance with all applicable communication laws (CAN-SPAM, TCPA, GDPR, CASL). Email tracking features insert tracking mechanisms. SMS charges are billed by Twilio. The Customer is solely responsible for obtaining consent, honoring opt-outs, and complying with anti-spam regulations. Klik Tik indemnifies itself against communication law violations by the Customer.
10. Payment Processing & E-Commerce
Klik Tik is NOT a payment processor. Payments are processed by Stripe via Stripe Connect. Klik Tik may collect an application fee (a percentage of transactions) as part of the Subscription. The Customer is responsible for tax compliance, refunds, and disputes. Klik Tik does not store payment card data. E-commerce sync (WooCommerce/Shopify) may result in data discrepancies. Invoices are for business management; the Customer ensures tax/legal compliance.
11. Electronic Signatures & Documents
Electronic signatures are intended to be legally binding under ESIGN Act, eIDAS, and equivalent laws. Klik Tik is NOT a certification authority. The Customer determines whether e-signatures are sufficient for their use case. An audit trail is maintained. Certain document types may not be valid with e-signatures in certain jurisdictions.
12. Public-Facing Features
Public booking pages, landing pages, and forms are the Customer's responsibility. Klik Tik is not a party to Customer/End User transactions. The Customer must include required legal disclosures and obtain data collection consents.
File Uploads
Files are stored on Google Cloud Storage with organization-level isolation. Certain file types may be blocked for security. File size limits and storage quotas may apply per Subscription plan.
Employee Time Tracking
Time tracking uses heartbeat-based activity monitoring that detects active and inactive periods. The Customer is responsible for informing employees, obtaining consents, and complying with employment/privacy laws.
13. Subscription, Fees & Payments
Multiple tiers (e.g., Free, Pro, Enterprise) with varying features and usage limits. Fees are non-refundable except as stated in Section 14. All subscriptions auto-renew. Annual plans require 30-day cancellation notice. Klik Tik may charge for excessive usage. Credits expire at end of Subscription period or 90 days.
14. Refund Policy & Chargebacks
Prorated refund available within 30 days of initial purchase only. Renewals are non-refundable. Initiating a chargeback may result in immediate account suspension and liability for fees.
15. Free Trials & Beta Services
Trials may be offered at Klik Tik's discretion. Beta services are "AS IS" with total liability capped at $100.
16. Acceptable Use Policy
The Customer shall not: violate laws, infringe rights, introduce malware, interfere with services, send spam, circumvent access controls, scrape data, or place unreasonable load on infrastructure. Klik Tik may suspend access immediately for violations.
17. Privacy & Security
See our Privacy Policy. Klik Tik implements reasonable security measures including encryption in transit, credential encryption (AES-256-CBC), multi-tenant isolation, role-based access controls, and cloud infrastructure security. No absolute security guarantee is provided. Security breach notification within 72 hours where required by GDPR.
18. Multi-Tenant Architecture
Customer Data is logically isolated at the Organization level in shared databases. Primary data region: US (us-central1). Appropriate safeguards (Standard Contractual Clauses) implemented for international transfers where required.
19. Service Availability
Klik Tik strives to maintain high availability but does not guarantee any specific uptime percentage. Specific uptime commitments, if any, will be in a separate SLA.
20. Confidentiality
Both parties agree to protect Confidential Information with reasonable care. Standard exclusions apply (public information, independently developed, etc.).

23. Indemnification
The Customer indemnifies Klik Tik against claims arising from: Terms violations, law violations, Customer Data, End User interactions, communication law violations, AI feature usage, e-signature usage, prohibited data processing, third-party integrations, tax/accounting failures, and employment claims from time tracking usage.
Klik Tik indemnifies the Customer against third-party IP infringement claims for the Services as provided.
24. Term & Termination
Customer may terminate at any time (effective end of billing period). Klik Tik may terminate for cause with 10-day cure period, or for convenience with 30 days notice (prorated refund). Klik Tik may suspend access pending investigation.
25. Effects of Termination
30-day read-only data retrieval period after termination. Data deleted from active systems within 90 days, backups within 180 days. Aggregated data is not deleted. Sections 4-7, 13-14, 17, 20-27 survive termination.
26. Dispute Resolution & Governing Law
Governed by the laws of the State of Delaware. Informal resolution first (30 days), then mediation, then exclusive jurisdiction in Wilmington, Delaware. Class action waiver applies to the maximum extent permitted by law.
27. General Provisions
Entire agreement. Severability. No waiver by non-enforcement. Customer may not assign without consent. Force majeure applies (excluding payment obligations). Notices via email or registered mail. Parties are independent contractors. English language prevails.
28. Changes to These Terms
Klik Tik may modify these Terms with 30 days advance notice for material changes. Continued use constitutes acceptance.
